1 – Application of the general conditions of sale
These conditions of sale are concluded, on the one hand between LA BELLE MINERVOISE, represented by JEAN CLAUDE MARCOMBES, and customers wishing to place an order on the site www.chambredhotecarcasson.com. Placing an order implies full acceptance of these general conditions of sale as well as the site’s privacy policy, available here . The customer who places an order acknowledges having read and accepted them.
The general conditions of sale may be modified at any time and without notice by LA BELLE MINERVOISE, in which case the applicable conditions will be those in force on the date of the order by the customer.
2- Products
The product sheets present the main characteristics of the products sold. The photos are not contractual, the packaging being subject to change. La Belle Minervoise cannot be held responsible for any errors or omissions appearing on the site. La Belle Minervoise cannot be held responsible for any errors or omissions appearing on the site.
The offers presented are valid within the limits of available stocks. La Belle Minervoise cannot be held responsible for non-performance of the contract in the event of a shortage of stock or in the event of force majeure.
3 – Prices
The prices are indicated in net Euros, exempt from VAT (VAT not applicable, article 293 B of the General Tax Code), and applicable on the date of the order by the customer. The authentic price is the one indicated on the description of the product. La Belle Minervoise reserves the right to modify its prices at any time.
Participation in shipping costs are charged extra. The amount of these costs is indicated in the basket.
4 – Orders
The customer who places an order must fill in the fields requested of him, in order to ensure the correct processing of his order. The customer must verify all the information provided and agrees on their veracity. La Belle Minervoise cannot be held responsible in the event of an input error on the part of the customer concerning the information requested of him, such as the delivery address for example.
All written communications between the seller and the customer such as order by e-mail are considered as proof of order.
A Belle Minervoise reserves the right to refuse or cancel an order from a customer with whom a payment dispute is in progress, in the event of a customer’s insolvency, or in the event of refusal of authorization payment by credit card notified by the payment platforms used, Stripe or Paypal depending on the method of payment chosen by the customer.
La Belle Minervoise accepts orders for delivery in mainland France (including Corsica) and in the countries specified on the Delivery page.
5 – Payment
Customers who place an order on the site have the following means of payment: payment by credit card secured by Stripe or Paypal.
The full amount of the order is due upon ordering.
6 – Delivery and reception
Delivery is made by La Poste according to the size of the products ordered. Delivery times are specified on the Delivery page.
Upon receipt, the customer is required to check the condition of the goods delivered and to issue reservations to La Poste if the products delivered are damaged or if the package has already been opened. La Belle Minervoise cannot be held responsible in the event of damage to the products during delivery by Colissimo, nor for delays in delivery due to La Poste.
7 – Right of withdrawal
The customer has a period of 14 days from receipt of the products to return them in order to proceed with an exchange or a refund. Return costs are the responsibility of the customer. The customer must first report the return to La Belle Minervoise by e-mail. The customer must return the new and intact products, in their original packaging, by Colissimo with the compensation insurance corresponding to the value of the products, to the address provided by La Belle Minervoise.
The refund is made within a maximum period of 14 days.
Damaged products will not be taken back.
8 – Guarantee and liability
La Belle Minervoise guarantees its products under the legal guarantee against hidden defects, provided for in articles 1641 and following of the Civil Code.
La Belle Minervoise cannot be held responsible for any damage caused in the event of improper use/conservation of the products by the customer.
9 – Complaints and applicable law
In the event of a complaint by the customer, the search for an amicable solution between the customer and La Belle Minervoise will be preferred.
In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, we offer a consumer mediation system. The chosen mediation entity is: CNPM – MEDIATION DE LA CONSOMMATION. In the event of a dispute, you can file your complaint on its website: https://cnpm-mediation-consommation.eu or by post by writing toCNPM – MEDIATION – CONSOMMATION – 27 avenue de la libération – 42400 Saint-Chamond.
However, in the event of a dispute, and if no amicable solution can be found, any legal action will be brought before the competent courts.
These general conditions of sale are subject to French law.
10 – Data protection
The information collected is necessary for the proper processing of the order by La Belle Minervoise.
In accordance with the law “Informatique et Libertés” of January 6, 1978 amended in 2004, the customer has the right to access and rectify or delete information concerning him, and which he can exercise by contacting at La Belle Minervoise
11 – Intellectual Property
All the elements and contents of this site are protected by intellectual property. Any distribution or reproduction of these contents is prohibited without the prior consent of their author.
